Personal data

Any information relating to an identified or identifiable natural person, and an identifiable person is one who can be identified directly or indirectly, in particular, by reference to an identifier or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity.

Personal data processed

Data collected through the Site, by email or in the context of Home Planning activity.

(potential) clients, Home Planning's contractual partners, users of the Site, Home Planning's contacts and their representatives.

Preliminary information

The purpose of this Policy is to provide information on the processing of Personal Data of Data Subjects, in the context of the rules of the data protection legislation applicable in Romania, including the Regulation, more specifically with regard to:

- the purposes for which Home Planning collects and uses the Data;

- the processing grounds on which those purposes are based;

- categories of Data collected and processed by Home Planning;

- the duration of the Data processing process;

- the rights of data subjects and the manner in which these rights may be exercised;

Provision of Personal Data

If Home Planning does not have at its disposal the categories of personal data requested, Home Planning's activity will not be able to be carried out for the above purposes.

Persons/entities providing Home Planning with Personal Data of other persons are required to inform Data Subjects, prior to disclosure of the Data, of how Home Planning will process their Data in accordance with this Policy.

Disclosure of Personal Data

As a rule, Home Planning does not disclose Personal Data to third parties, except to affiliates, contractual partners and service providers of Home Planning or competent authorities, in the context of providing the requested services, if necessary and in the interest of the Data Subjects.

Duration of processing of personal data

For Data processed under a contract with Home Planning, for the duration of the contract and after its termination, in accordance with Home Planning's legal obligations.

For Data that is not collected in the context of a contract, Data will be kept as long as necessary to fulfil the purpose of processing the Data.

Rights of Data Subjects

The Regulation gives Data Subjects a number of rights, such as:

Right of access

To confirm whether or not Personal Data are processed by Home Planning and, if so, to obtain relevant information on the processing of the Data.

Right to rectification

To correct Personal Data if inaccurate.

Right to erasure of Data

To delete Personal Data in certain cases (e.g. if it is no longer needed to fulfil the purposes for which it was collected).

Exception - Home Planning will not grant the request in all cases, such as when Home Planning has a legal obligation to keep the Data for a certain period or when the Data is useful for a legitimate interest such as defending a right in court.

Right to restrict processing

To request that Home Planning does not use the Personal Data, but only stores them until another request from the Data Subject is resolved, for: (i) rectification of the data; (ii) opposition to the deletion of the Data in the event of unlawful processing; (iii) request to provide the Data for the defence of a right; (iv) opposition to the processing of the Data.

The right to oppose

To object to the processing of Personal Data under the conditions and within the limits provided by law.

Exception - The law requires that this request be granted only for processing carried out for direct marketing purposes. Because Home Planning does not carry out this type of activity, Home Planning will ultimately weigh the interests of Home Planning against the particular situation of the Data Subject to make a final decision. It is therefore necessary that the Data Subject also explains the reason why he/she objects to this processing at the time of the request.

Right to data portability

To receive Personal Data provided to Home Planning in a structured, commonly used and machine-readable format or to send this data to another data controller.

Exception - The law requires the request to be granted only for Data previously processed on the basis of consent or for the performance of the contract concluded with Home Planning and only if the Data are processed by automated means.
